Personal Data Protection Clarification Text
Enorm Technology LLC. (Enorm) respects your privacy and values your data security. This text has been prepared to inform and enlighten you within the scope of Law No. 6698 on the Protection of Personal Data ("Law") and other relevant legislation.
Information
Law No. 6698 on the Protection of Personal Data was enacted on March 24, 2016, and published in the Official Gazette on April 7, 2016. However, according to Article 32 of the Law, titled "Enforcement," Articles 8, 9, 11, 13, 14, 15, 16, 17, and 18 came into force on October 7, 2016.
The Law was adopted to protect the fundamental rights and freedoms of individuals, especially the right to privacy in the processing of personal data, and to regulate the obligations and principles that natural and legal persons processing personal data must comply with. Therefore, this text has been prepared to fulfill the obligation of disclosure arising from the Law and is presented for the information and review of visitors under the title of "Protection of Personal Data and Personal Data Sharing Permission."
Enorm declares, represents, and undertakes that it will not sell, rent, or otherwise share the personal data (such as your name, email address, business and home address, and phone number) you provide through the forms on this site with third parties.
Processing of Your Personal Data
Processing of personal data refers to any operation performed on data, such as obtaining, recording, storing, retaining, modifying, reorganizing, disclosing, transferring, taking over, making it accessible, classifying, or preventing the use of personal data, wholly or partially, by automatic means or non-automatic means as part of any data recording system.
Data Controller and Representative
In accordance with the Law, your personal data may be processed by Enorm as the data controller within the scope explained in this text. Enorm determines the purposes and means of processing personal data recorded in its database and is responsible for the establishment and management of the data recording system. When the Data Controllers Registry is established, Enorm will complete its registration and obtain the status of a registered data controller.
Reasons for Processing Your Data
Your personal data is processed under Articles 5 and 6 of the Law for purposes such as:
Conducting necessary operational activities within the company to provide you with our products and services,
Conducting necessary studies with relevant business units and business partners to offer products and services tailored to your consumption and purchase motivation,
Ensuring human resource management within our company to safeguard individuals' rights,
Taking necessary steps for making, implementing, and realizing commercial decisions of our company,
Ensuring the legal security of real persons with whom we establish business relationships and our company.
Your personal data may be processed by Enorm as the data controller without the need for additional explicit consent in the following cases:
If the data subject cannot declare consent due to actual impossibility or if their consent is not legally valid, and processing is mandatory to protect their or another person’s life or physical integrity,
If processing is necessary for the performance of a contract to which the data subject is a party,
If processing is mandatory for the data controller to fulfill its legal obligations,
If the personal data has been publicly disclosed by the data subject,
If processing is necessary for establishing, exercising, or protecting a right,
If processing is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.
Your Personal Data May Be Processed for the Following Purposes:
Communicating with you and others as part of business operations,
Sending important updates regarding changes in our terms of service, electronic services, and other administrative information,
Ensuring quality, training, and security improvements (e.g., recording or monitoring phone calls made to our contact numbers),
Resolving complaints and processing data access or correction requests,
Complying with applicable laws and regulatory obligations (including those outside your country of residence), anti-money laundering, and counter-terrorism laws,
Managing and auditing our infrastructure and business operations, including compliance with internal policies and procedures related to accounting, billing and collections, IT systems, data and website hosting, business continuity, records, document, and print management,
Establishing and defending legal rights, protecting the activities, rights, privacy, security, or property of our company, business partners, or third parties, and enforcing available remedies or limiting damages,
Conducting market research and analysis, including customer satisfaction surveys,
Facilitating social media sharing functions,
Personalizing your experience with our electronic services by providing tailored content and advertisements.
To Whom and for What Purpose Processed Personal Data May Be Transferred
Your collected personal data may be transferred under Articles 8 and 9 of the Law for purposes such as ensuring the legal and commercial security of our company and its business relationships, enabling you to benefit from the products and services offered by our company, customizing our products and services according to your preferences, usage habits, and needs, determining and implementing our company's commercial and business strategies, and ensuring the execution of our human resources policies. These transfers may be made to our business partners, suppliers, shareholders, legally authorized public institutions, and private individuals.
Method and Legal Basis for Collecting Personal Data
Your personal data is collected through various channels and based on different legal reasons for the purpose of conducting our commercial activities. Personal data collected on this legal basis may also be processed and transferred for the purposes specified in sections (b) and (c) of this text, in accordance with the conditions and purposes for processing personal data specified in Articles 5 and 6 of the Law.
Rights of the Personal Data Owner under Article 11 of the Law
If you submit a request regarding your rights as a personal data owner using the methods outlined in this Clarification Text, our company will respond to your request as soon as possible and no later than thirty days, free of charge, depending on the nature of the request. However, if the Personal Data Protection Board determines a fee, our company will charge the fee set in the tariff.
In this context, personal data owners have the right to:
Learn whether their personal data is processed,
Request information if their personal data has been processed,
Learn the purpose of processing their personal data and whether they are used appropriately,
Know the third parties to whom their personal data has been transferred domestically or abroad,
Request correction of their personal data if it is incomplete or incorrectly processed and request notification of the correction to third parties to whom the data has been transferred,
Request deletion or destruction of their personal data in accordance with the provisions of the Law and other relevant legislation,
Object to the emergence of a result against them by analyzing the processed data exclusively through automated systems,
Demand compensation for damages in case of suffering harm due to the unlawful processing of personal data.
Under Article 13, paragraph 1 of the Law, you may submit your request to exercise the above-mentioned rights in writing or by other methods determined by the Personal Data Protection Board. Since the Board has not specified any method at this stage, you must submit your request to our company in writing under the Law.
